1. Acceptance
1.1By accessing or using DamoStar site, you hereby agree to accept the terms and conditions hereof, and that you will be bound by the terms and conditions contained in this Agreement. If you do not accept all of the terms and conditions of this Agreement, please do not use DamoStar Site.
1.2DamoStar may amend this Agreement at any time without any prior notice to you. The amended and restated Agreement shall be effective immediately upon posting. Your continuous use of our Service signifies your acceptance of the changed Agreement.
1.3Unless explicitly stated otherwise, any further upgrade, modification, addition or change to the Service, or any new function that augments or enhances our Service shall be subject to this Agreement. You may stop using the Service at any time.
2. Users
2.1damostar.com provides services to individuals and companies who can form legally binding contracts under applicable law. If you do not qualify, please do not use the Service.
2.2Users may use DamoStar Site solely for their own personal or internal purposes. Each User agrees that it shall not copy, reproduce or download any information, text, images, video clips, directories, files, databases or listings available on or through DamoStar for the purpose of re-selling or re-distributing the DamoStar Content, mass mailing (via emails, wireless text messages, physical mail or otherwise), operating a business that competes with DamoStar, or otherwise commercially exploiting DamoStar.
2.3We urge that you read DamoStar Privacy Policy which governs the protection and use of each User's information in DamoStar's possession. Each User hereby accepts the Privacy Policy and any updates and amendments thereto.
As a condition of your access to and use of DamoStar, you agree that you will not use the DamoStar service to infringe the intellectual property rights of others in any way. DamoStar will in appropriate circumstances terminate the accounts of members or users who are repeat infringers of the copyrights, or other intellectual property rights.
3. Registration Obligations
3.1You must be a Member in order to post information on DamoStar.
Each User hereby represents, warrants and agrees to (a) provide DamoStar with true, accurate, current and complete information to be displayed on the Site and (b) maintain and promptly amend all information to keep it true, accurate, current and complete.
3.3If you provide any information that is untrue, inaccurate, not current or incomplete, or DamoStar has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, DamoStar reserves the right at its sole discretion to suspend or terminate your Service without any prior notice to you.
3.4Each User who has registered with DamoStar by submitting an application form on DamoStar Sites and was thereafter approved by DamoStar as a member of DamoStar. DamoStar will establish an account for each Member and each Member will be assigned a Member ID and password for log-in access to its own Account.
4. Terms of Use
4.1You are solely responsible for maintaining the confidentiality of your Member ID and Password, and are fully responsible for all activities that occur under your Member ID and Password. DamoStar cannot and will not be liable for any loss or damage arising from your failure to comply with this Agreement. DamoStar does not have the duty for your damages causing by force majeure, such as attacks, any interrupts, or malfunction.
4.2You agree to use the Service only for purposes that are permitted by (a) the Agreement and (b) any applicable law, regulation or guideline in the relevant jurisdictions.
4.3You agree not to access (or attempt to access) any of the Service by any means other than through the interface that is provided by damostar.com.
4.4 You agree that you are solely responsible for (and that DamoStar has no responsibility to you) any breach of your obligations under the Agreement and for the consequences (including any loss or damage which DamoStar may suffer) of any such breach.
4.6damostar.com is entitled to send all kinds of business information relating DamoStar's services by the contacting you have provided (Including e-mail, mobile phone messages, etc. ). You must send a written notice to us if you refuse to continue to receive the business information.
5. Information Collection
5.1Only registered members can provide, post, send, publish or submit (also referred to as "provide") information (such as files, photographs, videos or other images about person and/or entity, products, services, offers, etc.) on damostar.com. DamoStar reserves the right (but shall have no obligation) to filter, modify, select and/or delete any or all information it deems inappropriate. Every member is solely & legally responsible for (and that DamoStar has no responsibility to you or to any third party for) the accuracy, completeness, integrity, timeliness, correctness and non-infringement of the information that you create, display, transmit or provide while using the Service and for the consequences of your actions (including any loss or damage which DamoStar may suffer) by doing so.
5.3Though DamoStar makes great effort to confirm the information provided, DamoStar does not guarantee & is not legally responsible for the accuracy, integrity, quality & non-infringement of such information.
5.4DamoStar collects information about persons/companies, products & offers, and builds its own database. DamoStar holds copyright over all related information and web designs. Any unauthorized copying or commercial use of content obtained from damostar.com is strictly prohibited, and DamoStar reserves right to take legal action in the case of such activity.
6. Dispute Resolution
6.1You agree to immediately notify DamoStar of any infringement or breach of your legal rights by using of Service and provide necessary evidences. You are liable for the authenticity and legitimacy of your deed.
6.2If the Member is in breach of any items of this Agreement or other terms, regulations and policies for the uses of any Service, according to the legally effective judgments or orders of the people's court verify or DamoStar' suspicion at its sole discretion, DamoStar reserves the right to publish the records of such breach on the website, and make other appropriate treatments, including but not limited to termination of Service, prohibition of the use of damostar.com permanently.
7. Termination
7.1DamoStar reserves the right to terminate your Service, refuse your use of Service or refuse your accessing damostar.com at any time for any reason, at its sole discretion, with or without notice. When your use of the Service is charged, we're entitled to doing so based on reasonable suspicion and notification by email, and not responsible for the consequences (including any loss or damage) of the actions by doing so.
7.2You will not be able to (a) use the website or the Service, (b) post, provide, send or publish information on the website, (c) allow others to post, provide, send or publish information on the website on your behalf. Your registration information or any other information you provided will be deleted or discard. We reserve the right to pursue your legal responsibilities for your breach of law or Agreement.
8. Limitation of Liability
8.1 The features and services on DamoStar are provided on an "as is" and "as available" basis, and DamoStar hereby expressly disclaims any and all warranties, express or implied, including but not limited to any warranties of condition, quality, durability, performance, accuracy, reliability, merchantability or fitness for a particular purpose. All such warranties, representations, conditions, undertakings and terms are hereby excluded.
8.2 DamoStar makes no representations or warranties about the validity, accuracy, correctness, reliability, quality, stability, completeness or currentness of any information provided on or through the site. DamoStar does not represent or warranty that the manufacture, importation, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the site does not violate any third party rights; and DamoStar makes no representations or warranties of any kind concerning any product or service offered or displayed on the DamoStar sites.
8.3 Any material downloaded or otherwise obtained through DamoStar Sites is done at each User's sole discretion and risk and each User is solely responsible for any damage to its computer system or loss of data that may result from the download of any such material. No advice or information, whether oral or written, obtained by any User from DamoStar or through or from DamoStar shall create any warranty not expressly stated herein.
9. Disclaimer of Warranties for Products Database
You expressly agree that use of our database contained on damostar.com is at your own risk. DamoStar shall not be responsible for any content found on this database. DamoStar expressly disclaims all warranties of any kind, whether implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DamoStar makes no warranty that our database will be uninterrupted, timely, securely or error free.
You acknowledge and agree that any material, and/or data downloaded or otherwise obtained through use of the database on damostar.com is done at your own discretion and risk. You will be solely responsible for any damages to your computer system or loss of data that result from the download of such material and/or data.
Some jurisdictions do not allow the exclusive of certain warranties, so some of the above exclusions may not apply to you.
10. Security
DamoStar adopts strict security policies. If any member should interfere with our security policies, they shall be temporarily or permanently banned from using damostar.com and its related services. In addition, information published by other members will not be available to those members whose access to damostar.com has been terminated.
11. Jurisdiction
The interpretation and application of this Agreement, as well as disputes relating to this Agreement, shall be dealt with in accordance with the laws of People's Republic of China.
12. Intellectual Property Rights
DamoStar is the sole owner or lawful licensee of all the rights to DamoStar Site and the DamoStar Content. DamoStar Site and DamoStar Content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in DamoStar Site and DamoStar Content shall remain with DamoStar. All rights not otherwise claimed under this Agreement or by DamoStar are hereby reserved.
"DamoStar" and related icons and logos are registered trademarks or trademarks, and are protected under applicable copyright, trademark and other proprietary rights laws. The unauthorized copying, modification, use or publication of these marks is strictly prohibited.
